On 6 February 2014, the Anti-Dumping Commission (the Commission) published a notice
announcing the initiation of an investigation into the alleged dumping and subsidisation of
silicon metal exported from the People’s Republic of China (China).
A full description of the goods is available in Anti-Dumping Notice (ADN) No. 2014/08. This
ADN is available on the Commission’s website at www.adcommission.gov.au.
The initiation notice advised that the statement of essential facts (SEF) for the
investigation would be placed on the public record by 27 May 2014. The SEF will set out
the facts on which I propose to base my recommendations to the Parliamentary Secretary
to the Minister for Industry (the Parliamentary Secretary). On 28 May 2014,
ADN No. 2014/45 notified an extension of time granted to issue the SEF to
25 August 2014.
Due to the complexity of the issues surrounding the investigation, I requested a further
extension of the deadline for the publication of the SEF. The Parliamentary Secretary
has, under section 269ZHI of the Customs Act 1901, further extended the deadline for the
publication of the SEF. The SEF will now be placed on the public record no later than
24 October 2014. Interested parties are invited to make submissions to the Commission
in response to the SEF within 20 days of the SEF being placed on the public record.
A recommendation to the Parliamentary Secretary will now be made in a report due on or
before 8 December 2014.
